Agreement Overview

These Terms of Service ("Terms") govern your use of The Glade mobile application and related services ("Service"). By downloading, installing, or using The Glade, you agree to be bound by these Terms. If you disagree with any part, please do not use the Service.

1. Eligibility and Account Registration

Age Requirement: You must be at least 13 years old to use The Glade. Users between 13-17 should review these Terms with a parent or guardian.

Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at support@theglade.app if you suspect unauthorized access.

Accurate Information: You agree to provide accurate, current information during registration and to update it as necessary.

2. License and Permitted Use

License Grant: We grant you a limited, non-exclusive, non-transferable, revocable license to use The Glade for personal, non-commercial purposes in accordance with these Terms.

Permitted Use: The Glade is designed for personal mindfulness, focus management, and reflection. You may use it to:

  • Create, store, and manage personal thoughts and focuses
  • Use widgets on your device home screen
  • Access inspirational quotes and content
  • Track your mood and maintain streaks
  • Sync data across your personal devices

3. Prohibited Activities

You agree not to:

  • Reverse engineer, decompile, or disassemble the application
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any illegal purpose or in violation of any laws
  • Transmit malware, viruses, or other harmful code
  • Use automated systems or bots to access the Service
  • Sublicense, sell, or redistribute the application
  • Remove or alter any proprietary notices or labels

4. Your Content

Ownership: You retain full ownership of all content you create within The Glade, including thoughts, focuses, notes, and any other personal data ("User Content").

License to Us: By using cloud sync features, you grant us a limited license to store and transmit your encrypted User Content solely for the purpose of providing the Service. We cannot and do not access, read, or use your content for any other purpose.

Responsibility: You are solely responsible for your User Content. We do not monitor, review, or filter personal content stored in the app.

Backup Recommendation: We strongly recommend enabling cloud sync or regularly exporting your data. While we implement robust systems, we cannot guarantee against data loss due to device failure, app deletion, or unforeseen circumstances.

5. Subscription and Payments

Free Tier

The Glade offers a free tier with core features including limited thoughts, basic widgets, and Daily Spark quotes. No payment information required.

Premium Subscription

Premium unlocks all features. Subscription details:

  • Billed monthly or annually through Apple App Store or Google Play
  • Includes a 7-day free trial for new subscribers
  • Auto-renews unless cancelled at least 24 hours before the end of the current period
  • Manage subscriptions through your device's app store settings

Price Changes: We reserve the right to modify subscription pricing. Existing subscribers will receive at least 30 days notice and will be grandfathered at their current rate for the remainder of their billing cycle. New prices apply upon renewal after the notice period.

Refunds: Refund requests are processed according to Apple App Store or Google Play policies. For issues not covered by platform policies, contact us at support@theglade.app and we will work to find a fair resolution.

6. Intellectual Property

Our Property: The Glade application, including its design, code, features, graphics, and branding (excluding User Content), is owned by us and protected by copyright, trademark, and other intellectual property laws.

Third-Party Content: Quotes displayed in Daily Spark are attributed to their respective authors and are curated for inspirational and educational purposes under fair use principles.

Feedback: If you provide suggestions or feedback about The Glade, you grant us the right to use that feedback without compensation or attribution.

7. Disclaimers

Not Medical or Mental Health Advice: The Glade is a productivity and mindfulness tool. It is not a substitute for professional medical, psychological, or psychiatric advice, diagnosis, or treatment. If you are experiencing mental health challenges, please consult a qualified healthcare provider.

Service Availability: We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

"As Is" Basis: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater
  • We are not liable for any loss of data stored locally on your device

Some jurisdictions do not allow certain liability limitations. In such cases, our liability is limited to the fullest extent permitted by applicable law.

9. Indemnification

You agree to indemnify and hold harmless The Glade, its creators, affiliates, and service providers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.

10. Termination

By You: You may stop using The Glade at any time. To fully terminate, delete the app and cancel any active subscriptions through your app store. You may also request account deletion by contacting us.

By Us: We may suspend or terminate your access if you materially breach these Terms, engage in fraudulent activity, or if required by law. We will provide notice when reasonably possible.

Effect of Termination: Upon termination, your right to use the Service ceases. Sections regarding intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

11. Modifications to Terms

We may revise these Terms from time to time. For material changes, we will provide at least 30 days notice via email or in-app notification before the changes take effect. Your continued use after the effective date constitutes acceptance of the revised Terms. If you disagree with changes, you should discontinue use before the effective date.

12. Governing Law and Disputes

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute Resolution: We encourage you to contact us first to resolve any disputes informally. If we cannot resolve a dispute within 30 days, either party may pursue formal resolution through binding arbitration or small claims court, at the claimant's election.

13. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Glade regarding the Service.

Severability: If any provision is found unenforceable, the remaining provisions continue in effect.

No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment: You may not assign your rights under these Terms. We may assign our rights to a successor in the event of a merger or acquisition.
